Walter John Lindsay pled guilty to felony grand theft by possession, I.C. Â§ 18-2403(4), in 1990 and was placed on probation for five years. Lindsays probation was revoked in 1992 for failure to make required restitution payments and for providing false information to the court and his probation officer. Lindsay appeals from the order revoking his probation. Because we conclude that the proceedings below were conducted in derogation of Lindsays right to counsel, we vacate the order revoking probation and remand this case for a new hearing on the alleged probation violation.
