In a trial before the court the appellant was convicted of the unlawful possession of less than two ounces of marihuana. Punishment was assessed at one day in the Dallas County Jail and a $200 fine. Appeal was taken to the Court of Appeals for the Fifth Supreme Judicial District of Texas, in Dallas, which affirmed the conviction. This Court granted the appellants petition for discretionary review on October 13, 1982.
